In Magistrates’ Court before Senior Magistrate, Mrs. Claire Faulds there was a swearing in of Reserve Police Constables for the Royal Falkland Islands Police. All were from the JSPSU at Mount Pleasant Complex.
The first case was that of Mr. Robert John Crowie, who pleaded not guilty to common assault contra to (section 39 of the Criminal Justice Act 1988). This offence took place on 14 December 2005. Rather than taking the case to trial the defendant accepted a binding over order for 6 months in the sum of £200.00. According to Senior Magistrate Mrs. Claire Faulds, had Mr Crowie not have been of previous good behaviour the binding over could have been for much longer. Mrs Faulds also initiated a new policy of getting a signature on Binding Over Orders.
In the case against Mr. Simon Gus Reid a guilty plea was received for (count 1) Sexual Activity with a Child contra to (section 9(1) of the Sexual Offences Act 2003) and (count 2) Sexual Activity with a Child contra to (section 9(1) of the Sexual Offences Act 2003. Both offences took place between 01 September 2005 and 15 December 2005. The Defence was not in a position at this time to proceed with the case as a pre-sentence report needed to be produced. Senior Magistrate, Mrs. Claire Faulds agreed and Mr. Reid was bailed with the condition that he not contact the victim himself or through a third party. The case will resume on 15 March 2006 at 1000hs.
In the case against Mr. Kenneth Barry Stewart for an assault on a Police Officer contra to (section 55 of the Police Ordinance 2000) resumed with a pre-sentence report received. The offence occurred on 13 November 2005. Due to the mitigating circumstances, Mr. Stewart was sentenced to 14 days in prison suspended for one year. Mr. Stewart had breached his probation but nothing further was going to be done about it.
The case against Mr. Peter James Crowie, Mr. Adrian James Minnell and Mr. Henry Browning was adjourned for a week so that 2 of the three defendants could get legal representation. All three were charged with Affray, contra to (section 3(1) of the Public Order Act 1986). The offence for which the three defendants were charged occurred on 27 December 2005.
Mr. Michael Barry Hirtle was charged with three counts of Drinking whilst on a prohibition order contra to (section 76(7)(a)(i) of the Licencing Ordinance 1994. He pleaded guilty to all three charges. The offences took place on 03 December 2005,09 December 2005 and 14 January 2006. Mr Hirtle was ordered to pay £70.00 prosecution costs but the case was adjourned until 15 March 2006 for a pre-sentence report.
