A session of the Magistrate's Court (Criminal) took place on Wednesday, 05 October 2005 at 1000 hrs.

FALKLANDS: COURT NEWS

A session of the Magistrate’s Court (Criminal) was held in the Town Hall on Wednesday, 05 October 2005 beginning at 1000 hrs.  Before Sr. Magistrate Mrs. Claire Faulds were:


 


Kenneth Barry Stewart for Impaired Driving contrary to section 19(1) of the Road Traffic Ordinance 1948 that occurred on 14 August 2005 (Count 1) and Harassment, contrary to section 2 of the Protection from Harassment Act 1997 that happened between 29 June and 14 July 2005 (Count 2)


 


SENTENCE: Probation Order – 18 Months, 3-year driving disqualification (can re-apply after 18 Months disqualification.


 


Christopher Hawksworth for Affray, contrary to section 3(1) of the Public Order Act 1986 (Count 1), Resisting Arrest, contrary to section 34(1) of the Crimes Ordinance 1989 (Count 2) and Criminal Damage, contrary to section 1(1) of the Criminal Damage Act 1971 (Count 3) all of which happened on 18 September 2005.


 


A formal adjournment was agreed due to the recent receipt of information by the Defence.  A Court date was set for Wednesday, 19 October 2005, at which pleas will be given.


 


Adrian James Minnell for Resisting Arrest contrary to section 34(1) of the Crimes Ordinance 1989 (Count 1) The incident happened on 18 September 2005.


 


A formal adjournment was agreed due to the recent receipt of information by the Defence.  A Court date was set for Wednesday, 19 October 2005, at which time a plea will be entered.


 


Ian Liggett for Speeding, contrary to section 29(1)(b) of the Road Traffic Ordinance 1948


 


Mr. Liggett pleaded guilty by letter but Mrs. Faulds continued the case because the speed limit was exceeded by more than 20 miles per hour and Mr. Liggett needed to be present for sentencing.
